ROAMING TECHNOLOGIES - TERMS AND CONDITIONS OF USE

Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Roaming Technologies Pty Ltd's (RT) relationship with you in relation to this website.

SALES POLICY

The prices displayed on the Roaming Technologies Pty Ltd Web Site (the "Site") are quoted in AUD dollars and are valid and effective only within the Commonwealth of Australia.

While we will use our best efforts to fulfill all orders, RT cannot guarantee the availability of any particular product displayed on this Site. RT reserves the right to discontinue the sale of any product listed on this Site at any time without notice.

While our goal is a 100% error-free Site, we do not guarantee that any content is accurate or complete, including price information, availability and product specifications. RT reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions (including after an order has been submitted and accepted). If we discover price errors, your order will suspended and you will be contacted, given the corrected price information and given the opportunity to confirm or cancel your order.

All of our products, unless specifically stated otherwise, are new.

PAYMENT, PRICE AND SHIPPING

Payment must be affected by credit card using the ordering facility on the website.
Prices are inclusive of goods and services tax (GST).  In all other respects, the price is exclusive of taxes, duties and charges imposed or levied in Australia or overseas in connection with the supply of goods or services.
Our prices are also inclusive of off-peak shipping with a carrier of our choice.   Where the customer selects a different form of shipping they will be charged as indicated on the Site.

BACK-ORDER POLICY

Every effort is made to ship customer orders complete. Complete orders will be shipped at once. Incomplete orders will be held for a short time so that RT can ship all items at one time. Most merchandise is in stock for immediate shipment and orders are processed within 24 hours.

If  RT should be temporarily out of stock on an item, customers are offered the choice on the Site to back-order the item or eliminate the item from the order. If no choice is made, the default is to back-order the item. RT will back-order that item and ship the remainder of customer order immediately. Customers must specify if they would prefer to delay shipment until the entire order is complete. If there are extended delays in back-ordered items, RT will email the customer with the details.

RETURN POLICY

Title and risk of loss pass to the customer upon tender of the shipment to the carrier. If the product is damaged in transit, the customer must file claim with the carrier as RT will not automatically accept returns for shipping damage.

If a product arrives defective or becomes defective during the warranty period of the product the customer must notify RT within 10 days.  RT will then arrange with the customer to exchange or receive a refund for the product, return shipping charges paid by RT. For warranty information and claims, refer to the Product Warranty for each individual product.

Orders that result in a return for any other reason, e.g. wrong item ordered, refusal, etc., will incur return shipping charges, and a re-stocking base charge of 20%. Such returns must be in new condition with original packaging. Returns not meeting this standard will be assessed additional restocking charges determined at the sole discretion of RT.

Before returning any product, contact RT by telephone at 1300 131 933 or by email at admin@roamingtech.com.au.   Returns are handled through a Return Material Authorization ("RMA") procedure. RT will issue the customer an RMA number, which must accompany the return shipment.

PRODUCT WARRANTY AND DISCLAIMER

Limited Warranty: All products sold are warranted by RT only to customers for use in business or in original equipment manufacture, against defects in workmanship or materials under normal use in accordance with the limited product warranty of the item ordered from the date of purchase from RT. Any product determined by RT to be defective in material or workmanship and returned to RT, shipping costs prepaid, will be, as the exclusive remedy, repaired or replaced, or at RT's option, the purchase price refunded.

NO WARRANTY OR AFFIRMATION OF FACT, EXPRESS OR IMPLIED, OTHER THAN AS SET FORTH IN THE LIMITED WARRANTY STATEMENT ABOVE IS MADE OR AUTHORIZED BY RT. RT DISCLAIMS ANY LIABILITY FOR PRODUCT DEFECT CLAIMS THAT ARE DUE TO PRODUCT MISUSE, IMPROPER PRODUCT SELECTION OR MISAPPLICATION, AND ANY DESCRIPTION DOES NOT EXPRESS OR IMPLY A WARRANTY THAT THE PRODUCTS ARE MERCHANTABLE OR FIT FOR A PARTICULAR PURPOSE. ANY LIABILITY FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES IS EXPRESSLY DISCLAIMED. RT'S LIABILITY IN ALL EVENTS IS LIMITED TO, AND SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE PRODUCT THAT GIVES RISE TO ANY LIABILITY.

SECURITY AND PRIVACY

The RT Site uses industry-standard encryption technology to provide for the security of vital information. Our Site is certified by Thawte, which verifies that our Site is authentic and that all transactions are secured by Secure Socket Layer (SSL) under 256-bit encryption. The Site is hosted, operated and maintained by RT and Clue Design. However, RT cannot guarantee that any electronic commerce on its Site is invulnerable to attack and totally secure.

RT does not release any personal or other customer information given to it when ordering, to any telemarketing company, reporting service, or any third party other than RT's credit card processor for the purpose of authorizing credit card transactions requested by the customer.

This Site may contain links to other sites that are neither owned nor operated by RT (collectively, "Third Party Sites". Such links are provided for your convenience only. RT makes no representations whatsoever about any Third Party Sites which you may access through this Site, as RT has no control over the content appearing on such Third Party Sites. By accessing and using this Site, you agree that your access and use of this Site are subject to these Terms and Conditions, as governed by the laws in force in the State of Western Australia.  You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.
